Challenging Parody Precedent
MTV News: Apparently, unique bands like Beatallica are no longer safe under the previous legal parody precedent set by 2 Live Crew almost a decade ago back in 1994. The unique Milwaukee band recently received a "cease and desist" letter from Sony/ATV Publishing - who administers the Beatles catalogue - to take down the songs posted on the band's website and to possibly pay monetary damages. According to the site's webmaster, "the songs had been downloaded and traded online an estimated 1 million times." Perhaps we should re-examine the protections afforded under the parody precedent, since there are other bands doing basically the same thing but without any similar repercussions. At the end of the day, that kind of traffic should be applauded rather than being challenged, especially if is truly done in the spirit of good humor. I guess that kind of comedic exposure is just too much to stomach for the copyright administrators as they obviously feel that they've suffered irreparable harm...
